Privacy policy

1. Who we are

Genius Development Agency (“GDA”, “we”, “us”) is a software development studio based in Surrey, British Columbia, Canada. We operate the website at geniusda.com (the “Site”). For anything related to this policy or your personal information, contact us at gda@geniusda.com. We are the organization responsible for the personal information collected through this Site.

2. What this policy covers

This policy explains what personal information the Site collects, why we collect it, where it is stored, who can see it, how long we keep it, and the choices you have. It applies to this Site only. When we take on client work, that engagement is governed by its own written agreement, which may include its own confidentiality and data handling terms.

3. Information you give us directly

The only place this Site asks for personal information is the contact form. If you submit it, we receive exactly what you typed:

  • Your name (required)
  • Your email address (required)
  • Your company name (optional)
  • The service you are asking about (required)
  • A budget range (optional)
  • Your message (required)

We do not ask for, and you should not send, government identifiers, financial account details, health information, or anything similarly sensitive. If your inquiry needs to include confidential business information, say so and we will arrange a proper channel first.

4. Information collected automatically

This Site does not use analytics tools, advertising trackers, or social media pixels, and it does not set tracking cookies. We do not build profiles of visitors and we do not follow you around the internet.

Like almost every website, the infrastructure underneath the Site keeps standard technical logs. Our hosting provider, Vercel, may record information such as your IP address, browser type, the pages you requested, and timestamps. These logs exist to operate the service, diagnose problems, and protect against abuse. We do not use them to identify visitors.

5. What we use your information for

We use the contact form information to:

  • Reply to your inquiry
  • Understand and scope the project you are describing
  • Keep a record of the conversation in case the project moves forward

That is the complete list. We do not sell your information, rent it, trade it, or add you to a mailing list. Submitting the form gets you a reply from a person, not a drip campaign.

6. Consent

By submitting the contact form, you consent to us collecting and using that information for the purposes above. You can withdraw that consent at any time by emailing us, in which case we will delete your inquiry unless we are required to keep it for a legal reason or we are already working together under an agreement that says otherwise.

7. Who your information is shared with

We do not share your personal information with anyone except the service providers that make the Site work:

  • Supabase hosts the database where form submissions are stored.
  • Vercel hosts the Site itself and processes requests to it, including form submissions in transit.
  • Telegram delivers an instant copy of each inquiry to us as a private notification so we can respond quickly. That copy contains the contents of your submission.

Each of these providers processes data under its own terms and security practices. Beyond them, we would only disclose personal information if a law, court order, or other legal process required it, or to protect against fraud or abuse of the Site.

8. Where your information is stored

Our service providers operate infrastructure that may be located outside Canada, typically in the United States. That means your information may be stored or processed in a jurisdiction with different privacy laws than Canada, and may be accessible to authorities there under local law. By submitting the form, you acknowledge this transfer.

9. How long we keep it

We keep inquiries for as long as they are useful for handling your request and any project that follows from it, and for a reasonable period afterwards as a business record. If you ask us to delete your information, we will remove it from our database promptly, normally within a few business days, unless we have a legal reason to retain it.

10. How we protect it

The Site is served entirely over HTTPS, so your submission is encrypted in transit. The database is not publicly accessible: it enforces row level security with no public access policies, and only our server, holding private credentials, can read or write inquiries. The internal page where we review inquiries is protected by authentication. No system is perfectly secure, but we have kept the attack surface deliberately small: no user accounts, no stored passwords for visitors, no payment processing on the Site.

11. Your rights

We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia’s Personal Information Protection Act (PIPA). You have the right to:

  • Ask what personal information we hold about you
  • Ask us to correct it if it is inaccurate
  • Ask us to delete it
  • Withdraw your consent to our use of it
  • Complain to the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner for British Columbia if you believe we have mishandled your information

To exercise any of these, email gda@geniusda.com. We will respond within a few business days and in any case within the timelines the law requires.

12. Children

This Site is aimed at businesses and is not directed to children. We do not knowingly collect personal information from anyone under the age of majority. If you believe a minor has submitted the form, contact us and we will delete the record.

13. Links to other sites

The Site may link to external websites, for example our GitHub repositories or a client’s product. Those sites have their own privacy practices, which we do not control and this policy does not cover.

14. Changes to this policy

If our practices change, we will update this page and the dates at the top before the change takes effect. We will not retroactively use information you already gave us in a way that this policy did not describe when you gave it.
